At Villa Conchita, we want you to enjoy your stay with complete peace of mind. That’s why we provide these Terms and Conditions, which clearly outline the rules, policies, and commitments from both sides, yours and ours. By booking with us, you agree to these conditions.

Terms and Conditions

IMPORTANT:

This is a web version intended for future guests.

The legal version is provided in the Temporary Rental Agreement once your booking is confirmed.

LENGTH OF STAY

The minimum stay is 3 nights, with check-in at 2:00 PM and check-out at 2:00 PM on the dates indicated in your confirmation.

  • Early departure: no refund will be issued.

  • Stay extensions: only in writing and subject to availability.

PAYMENTS

  • Deposit to confirm: 50% of the total amount within 24 hours after receiving the personal quote.

  • Balance: Must be paid before or upon arrival. It may be made in installment payments.

  • Accepted payment methods: Any of the methods authorized by the ADMINISTRATOR (consult them HERE).

Access to the PROPERTY will only be granted once full payment has been made; otherwise, the reservation will be considered canceled, and the cancellation policy indicated in this agreement will apply.

SECURITY DEPOSIT (DAMAGE DEPOSIT)

Fixed amount: $3,000 MXN (non-negotiable).

It must be paid before or upon check-in; without the deposit, the reservation will be considered canceled (cancellation policy applies).

Refund of deposit: within 1 to 5 business days after check-out, provided there are no:

  • Material damages (e.g., furniture/appliances due to misuse).

  • Loss of items (dishes, towels, decorations, etc.).

  • Extraordinary cleaning required (stains, tobacco odor, excessive trash).

  • Additional expenses (repairs, replacements, polishing, painting).

  • Breaches of these conditions or house rules.

In the event of any incident, the deposit may be withheld partially or in full, with costs and evidence provided to the GUEST. If expenses exceed the deposit amount, the GUEST is required to cover the difference.

GUESTS AND MAXIMUM OCCUPANCY

The rate only covers the guests declared at the time of booking.

Any change in the number of guests must be notified before arrival for a cost adjustment.

  • Extra guest fee (undeclared at check-in): $500 MXN per person, per night, payable before or upon arrival. If unpaid, access will not be granted, and the cancellation policy will apply.

  • Maximum occupancy: 15 people. Exceeding this number is strictly prohibited.

Only registered guests are allowed to stay overnight.

PETS

Pets are not allowed, except for emotional support animals with a valid medical certificate provided at the time of booking.

In case of authorization:

  1. Do not allow on beds/sofas/furniture.

  2. Must be supervised at all times.

  3. Waste must be collected and cleanliness/odors kept under control.

  4. Community rules must be followed (leash, waste disposal).

The property does not provide pet supplies.
Without a prior certificate, access will not be granted and the cancellation policy will apply.

ADDITIONAL SERVICES

  • Basic cleaning: $1,200 MXN (payable in advance or upon service).

  • For stays of 7+ nights: 1 basic weekly cleaning is included.

In all cases, it must be scheduled at least 10 days in advance; otherwise, it cannot be carried out.

External services (chef, tours, transportation, massages, laundry, etc.) are hired by the guest under their own responsibility, even if recommended by the administrator.

PROPERTY RULES

By using the PROPERTY, all GUESTS agree to comply with the following rules:

  1. Keep the PROPERTY clean, tidy, and in good condition, returning it as close as possible to how it was received.

  2. Use the facilities, furniture, and amenities responsibly and safely, at your own risk, avoiding any conduct that could cause damage or accidents.

  3. Use electricity responsibly, turning off lights and appliances when leaving, and keeping doors/windows closed in areas with air conditioning on.

  4. Immediately report any damage, accident, or irregular situation during the stay.

  5. Do not copy, duplicate, or tamper with keys, access devices, security systems, or connectivity devices.

  6. Do not move or remove furniture or objects from the PROPERTY.

  7. Smoking or vaping is prohibited inside the PROPERTY; only allowed outdoors with proper disposal of waste.

  8. It is forbidden to bring or consume illegal substances, or to engage in illegal, dangerous, unsanitary, immoral, or unlawful activities inside the PROPERTY.

  9. Moderate the volume of music and noise during nighttime hours.

  10. Only registered guests are allowed to stay overnight.

  11. Events or parties are not allowed without prior authorization; if authorized, the limit is 40 people, including guests.

  12. Minors must be supervised at all times, especially in and around the pool.

  13. Rinse off in the outdoor shower before entering the pool if coming from the beach or with sand.

  14. Do not bring food into the pool.

  15. Do not enter the PROPERTY while wet, as the floor is slippery and may cause accidents.

  16. Do not use glass or ceramic dishes, glasses, or cups in the pool area; plastic items are provided.

  17. Use towels designated for each area (bathroom and pool) exclusively in their corresponding place.

  18. Do not trespass onto the golf course; it is private property, with active players and security staff.

  19. Do not set up tents, bonfires, or other structures in the PROPERTY’s garden.

  20. Allow access to the ADMINISTRATOR, owners, or authorized staff for routine maintenance, inspection, repair, or emergency, respecting the GUEST’s privacy.

  21. The GUEST must purchase on their own any basic supplies once the courtesy items provided at check-in are depleted, as well as any additional supplies desired during their stay.

  22. The GUEST may not carry out recordings, broadcasts, or productions for commercial purposes within the PROPERTY without prior written authorization from the ADMINISTRATOR.

In addition to these rules, the GUEST must respect the regulations, instructions, and usage guidelines visibly displayed within the PROPERTY.

ADMINISTRATOR’S OBLIGATIONS

  • Deliver the villa in good condition and cleanliness.

  • Maintain services and amenities; repair failures not attributable to misuse.

  • Provide courtesy supplies for the first days (e.g., paper, soap, water).

  • Coordinate extra or included cleaning, as applicable.

  • Address reasonable questions related to the property.

  • Respect your privacy, except in the circumstances outlined in section 8.20.

  • Carry out inspection at the end of the stay and manage the return of the security deposit.

  • Inform about safety measures and ensure they are functioning properly.

CANCELLATION OR DATE CHANGE POLICY

Any date change or cancellation must be notified as soon as possible, and the following policy will apply:

DATE CHANGE

  • With more than 14 days’ notice: Subject to availability.

  • With less than 13 days’ notice: Subject to availability with a penalty of $3,000.00 MXN (Three thousand pesos 00/100 M.N.).

If the new requested period has a different price than the one originally contracted, the GUEST must cover the difference. If the adjustment is not accepted, it will be considered a cancellation by the GUEST, and the corresponding cancellation policy will apply.

 

CANCELLATION

  • With more than 28 days’ notice: Only 50% of the amount already paid will be refunded.

  • With less than 27 days’ notice: No refund will be issued.

CANCELLATION BY THE ADMINISTRATOR: Any payments made will be refunded within a maximum of 5 business days, or the STAY may be rescheduled at no additional cost, subject to availability.

EXTRAORDINARY CASES: In situations of force majeure such as natural disasters, fires, theft, public service outages, or other unforeseen events, the stay may be rescheduled at no additional cost, provided availability exists. In these cases, no refund will apply.

RESPONSIBILITIES AND LIMITATIONS

  • The guest is responsible for their own actions as well as those of their companions/guests/pets.

  • The administrator is not responsible for accidents, illnesses, losses, or damages during the stay, except in cases of non-compliance with their obligations, in which case liability is limited to 10% of the total contract value.

  • The villa is equipped with exterior security cameras (without invading private areas). Recordings will be made available to the authorities if required.

PENALTIES, BREACHES, AND TERMINATION

If the contract or house rules are violated, the administrator may apply the following sanctions:

  • Compensation up to 100% of the contract value.

  • Full or partial retention of the security deposit.

  • Late check-out penalty: deduction from the deposit and/or charging double the daily rate for each extra day.

  • Adjustment to the total cost for improper/excessive use of services/facilities.

  • Collection of legal expenses and fees arising from the breach.

Termination without refund and eviction/denial of access will apply in the following cases:

  • Failure or refusal to make full payment (including additional charges).

  • No-show within 12 hours after check-in time without prior notice.

  • Serious breach of these conditions or the house rules.
